Terms of Use

These terms are an agreement between you and FARMOUR VENTURES PRIVATE LIMITED ("we", "us"), Ambady Thellukuzhi, Perumkadavila P.O., Thiruvananthapuram, Kerala 695124, India, for the Rise with Gratitude app ("the app"). By installing or using the app you agree to them. Please also read our Privacy Policy.

1. What the app is

Rise with Gratitude is a wellness and self-improvement app with guided meditations, affirmations, a gratitude journal and short lessons. Guided narration is generated with AI text-to-speech. Version 1.0 has no AI chat or AI coach; coach replies are pre-written.

2. Not medical advice, not an emergency service

The app is not a medical, psychological or therapeutic service. It does not diagnose, treat, cure or prevent any condition and is not a substitute for a doctor, therapist or counsellor. The in-app support check (which may show helpline numbers after you save a journal entry) is a simple on-device word check. It can miss things and can show up when it isn't needed. It is not monitoring, and nobody is alerted. If you are in crisis, contact Tele-MANAS 14416 (India), emergency services (112 in India), or your local emergency number straight away.

3. Who can use it

You must be 18 or older ⚖ and able to form a binding contract.

4. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Android devices you own or control, for your own non-commercial use, in line with these terms and Google Play's terms. You may not:

• copy, redistribute, resell or extract the audio, scripts, text or artwork;
• reverse-engineer the app except where the law allows it, or bypass subscription, activation or download checks;
• use the app unlawfully or in a way that harms the service or other people.

All content and software belong to us or our licensors. Your journal is yours: it stays on your device and we claim no rights in it.

5. Free features and Rise Pro subscription

• Core features are free. Rise Pro unlocks premium content (for example Path days 4–21 and premium audio).
• Price: ₹999 per year in India, shown in Google Play (including applicable taxes) before you confirm. [Any other plans or a free trial — to be added once decided (D-15)] ⚖
• Billing: through Google Play only. We never see your card or bank details.
• Auto-renewal: the subscription renews automatically each year unless you cancel before the renewal date. Google Play reminds you before renewal as its policies require.
• Cancel any time in Google Play › Payments & subscriptions › Subscriptions. You keep access until the end of the period you have paid for.
• Refunds follow Google Play's refund policy. Contact Google Play first; you may also write to us and we will help where we can. Nothing here affects refund rights you have under law. ⚖
• Price changes: we will give you notice through Google Play before a new price applies, and you can cancel before it does.
• Uninstalling does not cancel a subscription.

6. Activation codes (Android only)

We may issue activation codes for gifts, testers, reviewers or organisations. Codes:

• work only in the Android app;
• are personal and non-transferable, and may be tied to a fixed number of devices;
• cannot be sold or exchanged for cash, and are not a way to buy Rise Pro outside Google Play;
• may expire on the date stated when issued;
• may be cancelled if obtained or used fraudulently, shared publicly or resold.

7. Your data and backups

Your journal is stored only on your phone and is not included in Android backups. If you lose or reset your phone without an export file, your journal cannot be recovered by us. Export files are not encrypted; keeping them safe is your responsibility. See the Privacy Policy.

8. Changes and availability

We may update, change or remove features or content, and we may suspend paid audio downloads for security reasons. If we permanently remove a significant paid feature during a period you have paid for, we will offer a fair remedy ⚖. We may ask you to update the app to keep using it.

9. Disclaimer

To the extent permitted by law, the app is provided "as is" and "as available". We do not promise any particular result from using it.

10. Limitation of liability

To the fullest extent permitted by law:

• we are not liable for indirect, incidental, special or consequential loss, or for loss of data you did not export;
• our total liability for any claim is limited to the amount you paid us for the app in the 12 months before the claim ⚖.

Nothing in these terms limits liability that cannot be limited by law, including your rights under the Consumer Protection Act, 2019.

11. Ending these terms

You can stop at any time by uninstalling the app (and cancelling any subscription in Google Play). We may suspend or end your licence if you seriously breach these terms.

12. Governing law and courts

These terms are governed by the laws of India. Subject to any mandatory consumer rights, the courts at [Thiruvananthapuram, Kerala] have exclusive jurisdiction ⚖.

Note for later markets (EU/UK): before launching in the EU, UK or other regions with strong consumer laws, this section needs a carve-out: consumers there keep the protection of the mandatory laws and courts of the country where they live, and statutory rights (including digital-content rights and withdrawal rules) cannot be excluded. ⚖

13. Changes to these terms

We may update these terms. We will change the date above and tell you in the app about important changes before they apply. If you do not agree, you can stop using the app and cancel your subscription.
